Spotlights Buyer Terms

These Spotlights Buyer Terms (“Buyer Terms”) apply when you view, purchase, rent, or subscribe to content through a Spotlight on the Skippz platform. They are an addition to, and form part of, the Skippz Terms of Service (the “Main Terms”) and the Skippz Privacy Policy.
The Skippz platform is operated by Avlanche Pty Ltd, of 132 Bower Street, Manly, NSW, Australia (“Skippz”, “we”, “us”, or “our”). “You”, “Buyer”, or “Viewer” means the person viewing or paying for content through a Spotlight. “Creator” means the person or organisation that publishes the Spotlight and sells or offers the content. Capitalised terms not defined here have the meaning given in the Main Terms.
By creating an account to access a Spotlight, or by viewing, purchasing, renting, or subscribing to content through a Spotlight, you agree to these Buyer Terms.
 

1. Skippz Is Not the Seller

Please read this section carefully, because it explains who you are actually dealing with.
The Creator is the seller. Skippz is not. Skippz provides the technology and platform that a Creator uses to publish and deliver their content. When you buy, rent, or subscribe to content in a Spotlight, your agreement is made directly with the Creator, and Skippz is not a party to that transaction.
This means the Creator, and not Skippz, is responsible for the content, its description, quality, and legality, the price, delivery and access, support, refunds, cancellations, disputes, and any promises made to you. Skippz does not sell, own, endorse, verify, or monitor Creators or their content, and does not check the truthfulness of any Creator’s description, claims, or contact details. Any purchase is a matter between you and the Creator.
 

2. Your Account and Access

You may be able to view free content as a guest where the Creator allows it. For any paid content, including purchases, rentals, and subscriptions, you must create an account.
You are responsible for your account and for keeping your login details secure. You must be old enough and legally able to enter into a contract to make a purchase, or have the consent and involvement of a parent or guardian where required. You are responsible for activity that occurs under your account.
 

3. What You Are Buying

Depending on what the Creator offers, you may:
  • Purchase a video or a Spotlight, which the Creator provides as ongoing (“lifetime”) access. This access is provided and maintained by the Creator and depends on the Creator keeping the content available on the platform. It is not a guarantee by Skippz, and it is not a transfer of ownership of the content to you.
  • Rent a video or a Spotlight for a limited period set by the Creator (for example, 24, 48, or 72 hours). A rental period begins when you first start watching the rented content and ends when the period expires, after which access stops.
  • Subscribe to a Spotlight for a recurring fee, which gives you access while your subscription remains active, including to content the Creator adds during that time.
  • View free content that the Creator has chosen to make available at no charge.
What is included, whether access is ongoing or time-limited, the price, and the currency are all set and described by the Creator. If something is unclear, contact the Creator before purchasing.
 

4. Payments

Payments are processed through the Creator’s own Stripe account. When you pay, your payment is taken through Stripe using the Creator’s connected Stripe account. Stripe processes the payment. Skippz does not process, receive, hold, or have access to your payment, and does not store your full card details. Your payment relationship is with the Creator and with Stripe, and your payment is handled under Stripe’s terms and privacy policy.
Where you have an account, you can view your invoices and purchases and manage or cancel subscriptions through the self-service portal associated with the Creator’s Stripe account. Receipts and billing records for your purchases are provided through Stripe.
 

5. Refunds, Cancellations, and Disputes

Refunds, cancellations, and payment disputes are handled by the Creator, not by Skippz. Skippz does not issue refunds for Spotlight purchases and is not responsible for the Creator’s refund or cancellation decisions. If you want a refund, wish to cancel, or have a problem with a purchase, you should contact the Creator using the details in their Creator profile. You may also be able to cancel a subscription yourself through Stripe’s self-service portal.
Any statutory consumer rights or guarantees you have in connection with a purchase are rights against the Creator as the seller. Nothing in these Buyer Terms excludes, restricts, or modifies any consumer right or guarantee that cannot lawfully be excluded under applicable law. Those rights, where they apply, are exercised against the Creator.
 

6. Content and Availability

The Creator controls their content and may add, change, archive, unpublish, remove, or delete videos or Spotlights, including content you have purchased, rented, or subscribed to. A Creator may also stop using the platform or disconnect their payment account, which can affect access or billing.
If your access to content changes or ends because of the Creator’s actions or decisions, that is a matter between you and the Creator, and Skippz is not liable for it. Where a Creator takes an action that affects content you have paid for, we may send you an email on the Creator’s behalf informing you of the action and including the Creator’s details so you can contact them. Skippz does not guarantee the continued availability of any content, and access provided by a Creator depends on the Creator.
 

7. Your Personal Data

When you provide information or interact with a Creator’s Spotlight, the Creator is the controller of that data and decides how it is used, and Skippz processes it on the Creator’s behalf as a processor, as described in the Skippz Privacy Policy. You should review the Creator’s own privacy notice to understand how they handle your information, and direct requests about that data to the Creator.
Separately, Skippz is the controller of your Skippz account data (such as your email and login), which is handled as described in the Skippz Privacy Policy. Your payment data is handled by Stripe under Stripe’s own privacy policy.
We may send you transactional and service emails relating to your access and purchases (for example, receipts, access changes, subscription updates, or refunds), including messages sent on a Creator’s behalf carrying the Creator’s branding but sent from Skippz email domains. We do not use your data to market our own products to you without a lawful basis. To exercise rights over your Skippz account data, contact us at support@skippz.com; to exercise rights over data held by a Creator, contact the Creator.
 

8. Your Licence to View

When you purchase, rent, or subscribe, the Creator grants you a limited, personal, non-exclusive, non-transferable licence to access and view the content for your own personal, non-commercial use, for as long as your access lasts. You do not acquire ownership of the content or any intellectual property rights in it.
Except where a Creator has expressly enabled downloads, and then only for your own personal use, you must not download, copy, record, screen-capture, redistribute, publicly perform, resell, or share the content or your access to it, and you must not circumvent or attempt to circumvent any access control or content protection. Sharing your account or access with others is not permitted.
 

9. Acceptable Use

You must not use a Spotlight or any content in a way that is unlawful, infringes anyone’s rights, or breaches the Main Terms. You must not attempt to gain unauthorised access to content you have not paid for, interfere with the platform, or misuse the payment or account systems.
 

10. Copyright and Content Complaints

If you believe content in a Spotlight infringes your rights or is otherwise unlawful, you can report it to copyrights@skippz.com. We may investigate and remove or disable access to content in accordance with the Main Terms. If content is removed following a complaint or for legal reasons, your access to that content may end. Skippz is not liable for the loss of access in those circumstances, and any refund you may be entitled to is a matter for the Creator as the seller.
 

11. Disclaimers and Limitation of Liability

The Skippz platform is provided to you on an “as is” and “as available” basis. We do not warrant that access will be uninterrupted or error-free, and playback quality can depend on your internet connection and device.
To the fullest extent permitted by law, Skippz is not liable for: the content offered in any Spotlight, or its accuracy, quality, legality, or availability; any act, omission, decision, or representation of a Creator; the price you paid or any refund, cancellation, or dispute; the operation of the Creator’s Stripe account or Stripe’s processing of your payment; or any unauthorised copying of content by others. These matters are the responsibility of the Creator as seller, of Stripe, or of third parties, as applicable.
To the fullest extent permitted by law, Skippz’s total aggregate liability to you in connection with the Spotlights platform will not exceed the total amount, if any, you have paid to Skippz (as distinct from amounts paid to a Creator) in the 12 months before the event giving rise to the claim.
Australian Consumer Law. Nothing in these Buyer Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
 

12. Changes to These Buyer Terms

We may update these Buyer Terms from time to time. The current version will be available on our website, and material changes will apply to your continued use of the Spotlights platform.
 

13. Governing Law and General

These Buyer Terms are governed by the laws of New South Wales, Australia, without affecting any mandatory consumer rights available to you where you live. The general provisions of the Main Terms apply to them.
